{"id":1185,"date":"2026-09-01T07:05:53","date_gmt":"2026-09-01T10:05:53","guid":{"rendered":"https:\/\/franzimconsultoria.com.br\/?p=1185"},"modified":"2026-08-28T18:08:53","modified_gmt":"2026-08-28T21:08:53","slug":"namoro-qualificado-stj-reforca-os-limites-entre-namoro-e-uniao-estavel","status":"publish","type":"post","link":"https:\/\/franzimconsultoria.com.br\/en\/newsletter\/namoro-qualificado-stj-reforca-os-limites-entre-namoro-e-uniao-estavel\/","title":{"rendered":"\"Qualified Dating\": Brazilian Superior Court of Justice Reinforces the Distinction Between Dating Relationships and Stable Unions"},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"1185\" class=\"elementor elementor-1185\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-63ebc3e e-flex e-con-boxed e-con e-parent\" data-id=\"63ebc3e\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-76c0c527 elementor-widget elementor-widget-text-editor\" data-id=\"76c0c527\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t\n<p class=\"wp-block-paragraph\">A recent decision by the Brazilian Superior Court of Justice (STJ), in Special Appeal No. 2.227.076, has once again brought attention to a legal concept that is becoming increasingly relevant in Family Law discussions: \u201cQualified Dating,\u201d a committed dating relationship that does not amount to a legally recognized stable union.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><u>In a case involving a child in common, a long-term relationship, and an engagement, the Third Panel of the STJ declined to recognize a stable union and held that the relationship should instead be characterized as a \u201cQualified Dating.\u201d<\/u><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision reinforces that the existence of a public, long-term relationship, even where the couple shares plans for a life together, is not, by itself, sufficient to establish a stable union under Brazilian law. <strong><u>The key element remains the existence of an already established family unit, rather than merely the intention to establish one in the future.<\/u><\/strong>In the case under review, despite the ties between the couple, the STJ found that their plans contemplated the formation of a family in the future, which precluded the characterization of the relationship as a stable union.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The concept of \u201cQualified Dating\u201d is once again gaining prominence as an important category for distinguishing relationships involving a higher degree of commitment, including cohabitation, joint planning, and even children, from situations in which a legally recognized family unit has already been established.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In estate and succession planning, the distinction between a \u201cQualified Dating\u201d and a stable union is particularly relevant, since <strong><u>the recognition of a stable union may produce significant property and inheritance consequences, including the sharing of assets and liabilities, as well as inheritance rights upon the death of a partner.
